Terms of Service

The terms that apply when you use Plural for visitors, customers, and applicants on pluralcareers.com or a connected custom domain.

These Terms of Service (the “Terms”) govern your use of Plural, including our marketing website, our hiring software, and any careers portal that an organization runs on Plural, whether served at pluralcareers.com or on a custom domain that the organization has connected to Plural. Please read these Terms carefully before using the Service.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have the meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms:

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.

  • Applicant means an individual who submits an application or other information to a Customer through a Careers Portal or other application surface provided by the Service.

  • Application means the Plural hiring software, including the applicant tracking system and admin tools that Customers use to manage hiring.

  • Careers Portal means the public job board, job posting pages, and application forms that a Customer publishes through Plural. A Careers Portal may be served on pluralcareers.com (or a Plural-managed subdomain) or on a Custom Domain that the Customer has connected to Plural.

  • Company (referred to as either “the Company”, “Plural”, “We”, “Us”, or “Our” in this Agreement) refers to Plural, a service maintained and operated by Twenty Miles West, LLC, 1300 South Blvd STE 30004, Charlotte, NC 28203.

  • Country refers to the State of North Carolina, United States.

  • Customer means an organization that subscribes to or uses the Application to run hiring, including the Customer’s owners, administrators, recruiters, hiring managers, and other authorized team members.

  • Custom Domain means a domain name owned or controlled by a Customer (for example, careers.example.com) that the Customer has configured to serve their Careers Portal through Plural.

  • Customer Content means the content that a Customer uploads, posts, or otherwise makes available through the Service, including job postings, branding assets, hiring stages, candidate notes, evaluations, and team communications.

  • Device means any device that can access the Service such as a computer, a cellphone, or a digital tablet.

  • Service refers, collectively, to the Website, the Application, every Careers Portal we host (whether on pluralcareers.com or a Custom Domain), and any related features, APIs, and communications operated by Plural.

  • Terms mean these Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.

  • Visitor means any individual who accesses the Website or a Careers Portal without creating an account or submitting an application.

  • Website refers to Plural’s marketing site, accessible from https://pluralcareers.com.

  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service. “You” includes Visitors, Customers, and Applicants.

Acknowledgment

These Terms set out the rights and obligations of all users of the Service. They apply to:

  1. Visitors who browse the Website or a public Careers Portal.
  2. Customers (including their owners, admins, recruiters, and other team members) who use the Application to run hiring.
  3. Applicants who apply for jobs or otherwise share information through a Careers Portal hosted on pluralcareers.com or on a Custom Domain.

These Terms apply the same way regardless of which domain you use to reach the Service. A Careers Portal served on a Custom Domain is still part of the Service and is governed by these Terms. A Customer may also have its own additional terms for its hiring process; those additional terms operate alongside these Terms but cannot expand Plural’s obligations under these Terms.

By accessing or using the Service, You agree to be bound by these Terms. If You do not agree with any part of these Terms, You may not access or use the Service.

You represent that You are at least 18 years old (or the age of majority in Your jurisdiction, if higher). The Company does not permit individuals under that age to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with our Privacy Policy and Cookie Policy.

Accounts

To use the Application, a Customer must create an account. Customers are responsible for:

  • Providing accurate and current information.
  • Keeping login credentials confidential and secure.
  • All activity that occurs under their account.
  • Promptly notifying us of any unauthorized use of an account or any other security incident affecting the Service.

We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms or applicable law.

Customer Content and Applicant Submissions

Customer Content

Customers retain ownership of their Customer Content. Customers grant Plural a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting and display), and transmit Customer Content solely as necessary to provide the Service, including to publish job postings on Careers Portals (whether on pluralcareers.com or on a Custom Domain), deliver applications to the Customer, and provide support.

Customers are solely responsible for their Customer Content, including its accuracy, legality, and compliance with employment, equal-opportunity, advertising, and data-protection laws.

Applicant Submissions

When an Applicant submits an application or other information through a Careers Portal, that information is shared with the Customer that posted the job. Plural processes Applicant submissions on the Customer’s behalf, in accordance with our Privacy Policy. Applicants represent that the information they submit is accurate and that they have the right to share it.

Plural is a software platform; it is not the employer for any job posted on a Careers Portal, does not make hiring decisions, and is not responsible for a Customer’s hiring practices, communications, or compliance with employment law.

Custom Domains

Customers may connect a Custom Domain to serve a Careers Portal. By doing so, the Customer represents and warrants that they own or have the right to use that domain. The Customer is responsible for maintaining DNS configuration, domain registration, and any related certificates that they control. Plural may suspend a Custom Domain configuration if it is used in violation of these Terms or applicable law, or if it materially impacts the Service.

Regardless of whether a Careers Portal is served on pluralcareers.com or on a Custom Domain, the Service is still operated by Plural and is governed by these Terms, our Privacy Policy, and our Cookie Policy.

Acceptable Use

You agree not to:

  • Use the Service in violation of any applicable law or regulation, including employment, anti-discrimination, advertising, intellectual-property, export, and data-protection laws.
  • Submit false, misleading, defamatory, or unlawful content.
  • Post job listings for positions that do not exist, are not legally permissible, or are intended to collect Personal Data under false pretenses.
  • Reverse engineer, decompile, or attempt to extract source code from the Service, except to the extent that applicable law expressly prohibits this restriction.
  • Probe, scan, or test the vulnerability of the Service, breach any security or authentication measures, or interfere with or disrupt the Service or any user’s use of it.
  • Use the Service to send spam, phishing messages, malware, or other unwanted communications.
  • Use bots, scrapers, or automated tools to access the Service except as expressly permitted by Plural.
  • Use the Service to develop a competing product or to benchmark it for that purpose without Plural’s prior written consent.
  • Resell, rent, or sublicense the Service to a third party except as expressly permitted by Plural.

We may investigate and take appropriate action against any conduct that we reasonably believe violates these Terms, including suspending or terminating access and reporting to law enforcement.

Fees and Payment

Some features of the Application require a paid subscription. Customers agree to pay all fees due in accordance with the pricing and billing terms presented at the time of purchase. Unless stated otherwise, fees are non-refundable. Plural may change fees on a going-forward basis with reasonable notice. Customers are responsible for any taxes that apply to their use of the Service.

If You access the Website or a Careers Portal as a Visitor or Applicant, the Service is generally free of charge to You. Plural does not charge Applicants to apply for jobs.

Intellectual Property

The Service, including all software, design, branding, text, graphics, and other content provided by Plural (excluding Customer Content and Applicant submissions), is owned by Twenty Miles West, LLC or its licensors and is protected by intellectual-property laws. Plural grants You a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. No other rights are granted by implication, estoppel, or otherwise.

You may not remove or alter any proprietary notices on the Service. Any feedback You voluntarily provide to Plural about the Service may be used by Plural without restriction or obligation.

Third-Party Services and Links

The Service may integrate with or link to third-party websites or services that we do not control. We are not responsible for the content, availability, terms, or practices of any third party. Your use of third-party services is subject to those services’ own terms and privacy notices.

Termination

You may stop using the Service at any time. Customers may also cancel their subscription as described in the Application or by contacting us.

We may suspend or terminate Your access to all or part of the Service at any time, with or without notice, if We reasonably believe You have violated these Terms, if Your use of the Service creates a security or operational risk, if We are required to do so by law, or if We discontinue the Service. Sections that by their nature should survive termination (including ownership, disclaimers, indemnification, limitation of liability, and dispute provisions) will survive.

Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PLURAL AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, PLURAL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

PLURAL IS NOT THE EMPLOYER FOR ANY JOB POSTED ON A CAREERS PORTAL AND DOES NOT GUARANTEE THE OUTCOME OF ANY APPLICATION OR HIRING PROCESS.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to You. In those jurisdictions, the exclusions apply to the greatest extent enforceable under applicable law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PLURAL OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF PLURAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PLURAL’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID PLURAL FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (b) ONE HUNDRED U.S. DOLLARS ($100).

These limitations apply regardless of the legal theory on which the claim is based. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to You.

Indemnification

To the maximum extent permitted by applicable law, You agree to defend, indemnify, and hold harmless Plural, Twenty Miles West, LLC, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) Your violation of these Terms; (b) Your use or misuse of the Service; (c) Your Customer Content or other content You submit; or (d) Your violation of any rights of a third party or any applicable law.

Governing Law

The laws of the Country, excluding its conflicts-of-law rules, govern these Terms and Your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting us. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and You consent to the personal jurisdiction of those courts.

For European Union (EU) Users

If You are a European Union consumer, You will benefit from any mandatory provisions of the law of the country in which You are resident.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to a United States government embargo or designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision will be changed and interpreted to accomplish the objectives of the provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

Except as expressly stated in these Terms, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise that right or require that performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms may have been translated if We have made them available to You on the Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide notice (for example, by email, through the Application, or by updating the “Last updated” date above) before the revised Terms take effect. By continuing to access or use the Service after the revisions become effective, You agree to be bound by the revised Terms. If You do not agree to the new Terms, in whole or in part, please stop using the Service.
